End User T&C for 6G PAY Services

 

INTRODUCTION

6G Digital Remittance Ltd. is committed to ensuring that customers have the best experience while using the products and services available through its website, www.6GPay.ca. Accordingly, we have updated our Terms of Service in compliance with Canadian laws, including the General Data Protection Regulation.

Acceptance of Terms

  • This Agreement, effective as of 1st of Mar 2024, outlines the terms governing your use of the services accessible at www.6gpay.ca (“Service”). Your decision to use the Service indicates your agreement to comply with all the terms stated in this User Agreement.
  • Throughout this Agreement, references to “6G Pay”, “we,” “us,” and “our” pertain to 6G Digital Remittance Ltd., a Canadian Provincial Corporation, inclusive of its employees, directors, successors, and assignees.
  • “You” and “your” in this Agreement refer to anyone utilizing the Service, whether as a Sender, Recipient, another user, or a website visitor.
  • These Terms and Conditions take effect from the date of your first access, registration, or use of the Service and are subject to future modifications.
  • The Service was crafted to streamline international money transfers, enabling customers to send and receive funds from their global network of family and friends.

 

Definitions

  • “App” refers to the mobile application provided by 6G Digital Remittance Ltd., for initiating Payment Requests and/or Transaction Requests, where available.
  • “Business Day” pertains to any day on which 6G Pay operates for Transaction Requests and/or Payment Requests.
  • “Destination Country” indicates the country where the Payee receives money through the Service.
  • “Instruction” signifies a Payment Request and/or a Transaction Request.
  • “Payment Instrument” represents a valid payment method, such as a bank account, debit card, or credit card.
  • “Payment Request” is a specific instruction from you to a Sender requesting a Transaction.
  • “Prohibited” refers to activities prohibited by 6G Pay’s policies, including narcotics, steroids, pharmaceuticals, chemicals, drug paraphernalia, tobacco, seeds, plants, animals, military or semi-military goods or services, weapons, adult services or content, bitcoin or other cryptocurrency, binary options, gambling services, or any other prohibited activities as determined by 6G Pay.
  • “Recipient” designates a Payee to whom the funds are being sent.
  • “Remittance” denotes the money transfer to the intended beneficiary by the sender.
  • “Sender” is an individual using the Service to send money.
  • “Services” encompass money transfer services.
  • “Service Fee” refers to 6G Pay’s fee, inclusive of additional charges or local taxes applicable to each Transaction, which 6G Pay may charge at its discretion in accordance with applicable laws. Details are available in these Terms and Conditions and on the 6G Pay website.
  • “Service Provider” stands for a local bank, money exchange house, or other third-party service providers (e.g., Payment Aggregators) in the Destination Country collaborating with 6G Pay to provide the Service.
  • “Transaction” is the transfer of money or remittance.
  • “Transaction Amount” represents the money amount, excluding any applicable Service Fee and prior to any foreign exchange conversion.
  • “Transaction History” comprises the record of your Transactions on our website, accessible using your email and password registration details.
  • “Transaction Request” is a specific instruction from you, requesting 6G Pay to send money or provide AirTime Top-Up to a Payee through the Service.
  • “Website” pertains to 6G Pay’s web portal for initiating Payment Requests and/or Transaction Requests, where available.
  • “6G Pay Wallet” refers to a function in the App or website storing E-money in a non-interest-bearing virtual account maintained by us for a Wallet holder. It provides features such as checking the balance, loading additional funds, and giving instructions for E-money transactions or cash withdrawals. These funds cannot be transferred to another 6G Pay Wallet holder or anyone’s bank account except for the account holder/Wallet holder.

 

Responsibilities of 6G Pay

  • In accordance with these Terms and Conditions, we commit to providing the Service to you with reasonable care. It is understood that the service may not be available, either wholly or partially, in certain regions, countries, or jurisdictions.
  • 6G Pay, subject to the Terms and Conditions outlined in this Agreement, will treat each Transaction request as the customer’s instruction to make a payment or instruct the beneficiary bank or another financial institution to make a payment to a designated beneficiary. This will be facilitated through correspondent banks or other appropriate means. 6G Pay reserves the right to seek additional instructions from the customer using the provided phone number or email address at the time of signing up. The customer is required to comply with all such requests; failure to do so may result in 6G Pay refusing to process the Transaction request. 6G Pay is not liable for non-verification of Payment requests.
  • 6G Pay holds the right to modify or discontinue the Service, or any part thereof, without notice, at its discretion, at any time and periodically.
  • We retain the absolute discretion to refuse any Transaction Request or set limits on the Transaction Amount. This may occur on a per Transaction basis or on an aggregate basis, for one set of registration details or one Payment Instrument, or for related sets of registration details or Payment Instruments. We may, at our sole discretion, change the Payment Instruments we accept at any time.
  • The delivery times for processing remittance orders, as quoted on our service levels or elsewhere on our website, are indicative of the “normal” or average service and do not guarantee an individual Service or Transaction time. The duration begins only after receiving a complete and accurate Transaction request along with all necessary funds, including fees and charges, from the customer. This timeframe is subject to change based on factors such as compliance hold or service unavailability.
  • While we aim to process transactions promptly, delays or cancellations may occur for various reasons. These include our efforts to verify your identity, validate transaction instructions, contact you, variations in business hours and currency availability, or compliance with applicable laws.
  • Notifications related to transactions may be sent and received via email, SMS, or through the notification section of your profile on the 6G Pay website or App. After receiving a transaction request, we will provide you with information allowing you to identify the transaction. This information includes details on the transaction amount in the currency used, our Service Fee, exchange rate, and the date of receiving the transaction request.
  • We endeavor to offer Senders and Recipients updated information on the location and opening hours of our Service Providers through our website. However, 6G Pay is not accountable for inaccuracies in this information or any consequential loss resulting from incorrect or incomplete details.

 

Responsibilities of the Customer

  • Ensure that you are at least 18 years old and possess the legal capacity to form a binding legal contract in any relevant jurisdiction before accessing, using, or attempting to use the Service.
  • Pay the stated Service Fee, in addition to the Transaction Amount, for each Transaction Request submitted. The Service Fee becomes due at the time of submitting the Transaction Request. To the maximum extent permitted by law, the Service Fee is non-refundable unless expressly stated otherwise in these Terms and Conditions.
  • Acknowledge the possibility of a convenience/miscellaneous fee being applied for processing credit cards/debit cards/Interac e-transfer at our discretion. Any such fee will be disclosed to you before the submission of the applicable Transaction Request.
  • In connection with your registration and use of the Service:
  • Provide true, accurate, current, and complete evidence of your identity, promptly updating personal information as needed.
  • Furnish any identity documentations as requested.
  • Provide details of one or more Payment Instruments.
  • Offer true, accurate, current, and complete information required for receiving the Service and any other information related to the Recipient.
  • Provide any other information necessary for the proper execution of a Transaction Request, as specified during the entry of Transaction details on our website.
  • Supply information relating to the Transaction as required for processing the request.
  • Liability: we disclaim any liability for losses or damages resulting from non-payment or delay in payment of a Payout Amount to a Payee if the Customer fails to fulfil their responsibilities listed in this section.

Accuracy of Details:

Ensure all details are accurate before submission when using the Service. Once a Transaction Request is received, changes are not normally possible. You will be given the opportunity to confirm Transaction Requests before submission, and it is crucial to check the details carefully.

Display of Information:

The total amount, including the Transaction Amount, Service Fee, and other applicable fees and charges, along with the relevant exchange rate, will be clearly displayed before asking you to confirm your Transaction. Proceeding with the Transaction at this point is entirely optional.

Currency Exchange:

When paying a Transaction Amount in one currency and the Payout Amount is in another currency, there will be a difference between the exchange rate at which we buy foreign currency and the exchange rate provided to you. 6G Pay and its Service Providers may make a small profit in these circumstances.

Purpose of Transactions:

Use the Service only to send Transaction Amounts to people you know personally, not for paying third parties you do not know and trust. 6G Pay may refuse to process your Transaction Request if it believes the Service is being used for fraudulent, illegal, or Prohibited activities.

Acting on Own Behalf:

Both you and the Recipient will only act on your own behalf. Instructions or Transactions cannot be submitted or received on behalf of a third person.

Compliance:

Comply with these Terms and Conditions and any applicable laws, rules, or regulations. Using the Service for illegal activities, money-laundering, fraud, or funding terrorist organizations is a breach of these Terms and Conditions.

Conduct:

When using the website, Service, or interacting with 6G Pay, other users, or third parties, you will not:

  • Breach these Terms and Conditions or any other agreement with 6G Pay.
  • Create more than one registration without prior written permission.
  • Provide false, inaccurate, or misleading information.
  • Allow anyone else access to your registration details; keep those details safe and secure.
  • Refuse to provide confirmation of any information or co-operate in any investigation.
  • Use anonymizing proxies or devices.
  • Copy or monitor the website or Services using any robot, spider, or other automatic device or manual process without prior written permission.
  • Legal Advice: acknowledge that nothing in these Terms and Conditions or any information provided by 6G Pay constitutes legal or other advice. Consult your professional advisers for advice on the effects of Canadian or foreign laws that may apply to the Service.

Documentation and Identification

  • Canadian federal and provincial laws mandate financial institutions to aid in combating money laundering and terrorism funding by obtaining, verifying, and recording identifying information about all customers. Accordingly, we may request personal identifying information concerning you and the Recipient, and we may also legally consult other sources to obtain relevant information.
  • 6G Pay may ask customers to provide documents related to the source of funds and any other documentation necessary to process remittance requests. Compliance with such requests is essential, and failure to do so may lead to the refusal of instructions or the processing of remittance/payment service requests by 6G Pay.
  • In cases where the information provided for your account is unsatisfactory and does not meet our risk assessment criteria, we reserve the right to deny you our service, with a refund processed via your original payment method.
  • We may disclose information about you and your financial transactions to government authorities and law enforcement agencies. The right to report any suspicious financial transactions to relevant government authorities, including law enforcement agencies, is reserved.
  • You agree that 6G Pay, at its sole discretion, may terminate your account or use of the Site or the Services and remove and discard any content within the Site at any time and for any reason. Actions taken under this section may be effected without prior notice to you.

 

Charges and Fees

Fees and charges assessed by 6G Pay will be determined at the time the transaction is created or finalized. 6G Pay reserves the right to change its fees and other charges from time to time without notice to the customer.

In addition to standard service fees, 6G Pay may apply charges for specific requests, such as Payment Trace Requests, Returns, Cancellations, and Recalls, which will be based on fees incurred from 6G Pay’s banking partner. Reversal of a transaction involving currency conversion may also be subject to an FX Margin.

Fund Transfers to the Recipient

The customer acknowledges that payments are made solely based on the name and account number or wallet number of the beneficiary and the identification numbers of the banks and wallet providers specified by the customer, even if such numbers designate a different person or bank. 6G Pay’s responsibility does not extend to discrepancies in beneficiary names, account numbers, or identification numbers of banks that may cause funds to be returned, misrouted, lost, or result in delays in fund receipt. The customer acknowledges that 6G Pay shall not be held liable for any loss or damages resulting from such errors or inconsistencies.

  • 6G Pay does not guarantee when the beneficiary’s account will be credited, and funds may be delayed or services may be unavailable based on various conditions. 6G Pay shall not be held liable for any conditions, sanctions, penalties, delays, or non-payment.
  • At its discretion, 6G Pay may provide the customer with passwords or other authenticating information for use with each payment request. The customer is responsible for ensuring the security and confidentiality of such information from unauthorized use or access.
  • Cancellation of Payment Requests and Transactions shall be governed by these Terms and Conditions. Customers must cooperate with 6G Pay in handling cancellation requests and shall promptly refund monies upon request, where 6G Pay reasonably believes that transactions contravene these Terms and Conditions.

 

Refunds, Refusals and Terminations

  • We retain the right to refuse, suspend, or cancel any Transaction Request, Payment Request, or Transaction at any time for any reason, or cancel it where relevant. The following outlines situations in which this may occur:
  • In our absolute discretion, we may refuse or cancel Transaction Requests, Payment Requests, or Transactions if we believe the Service is being used for illegal, fraudulent, or Prohibited activities.
  • We may refuse or cancel Transaction Requests, Payment Requests, or Transactions to or from certain Senders or Payees, as required by law or where there are suspicions of violating anti-money laundering or counter-terrorism financing laws. Refusal may also apply to certain entities or individuals on restricted or prohibited lists.
  • In our absolute discretion, we may refuse or cancel Transaction Requests or Transactions if we suspect the use of the Service for purchasing goods or services from unknown or untrusted third parties.
  • We may refuse or cancel Transaction Requests, Payment Requests, or Transactions if:
  • We cannot verify your identity or that of the Recipient.
  • You fail to comply with information requests related to the Transaction.
  • We reasonably believe you are using the Service in violation of these Terms and Conditions or applicable laws.
  • Upon refusal or cancellation of a Transaction Request, Transaction, or Payment Request, 6G Pay may, at its discretion, temporarily or permanently suspend your Registration.
  • In cases of temporary or permanent suspension of your Registration or refusal/cancellation of a Transaction Request, Payment Request, or Transaction, 6G Pay reserves the right to retain any incurred Service Fees.

 

Customer’s Right to Cancel; Refunds

  • The customer acknowledges that the request for Services is irrevocable, and 6G Pay is not obligated to accept a stop-payment order after the execution of a Payment request.
  • 6G Pay, at its discretion, may attempt to cancel your Instruction if you express the wish to revoke it. Successful revocations may lead to a refund of your money, minus any reasonable revocation charges and already incurred Service Fees, within five (5) Business Days.
  • If you encounter any issues using the Service or are aware of unauthorized or incorrectly executed Transactions, you should contact us through the provided channels within 6 months from the debit date. Refund requests must be submitted in writing, including by email, providing necessary details.
  • If a Transaction is executed based on incorrect information provided by you, we are not liable for the incorrect execution but will make best-effort attempts to recover the funds, potentially charging a reasonable fee.
  • In cases where 6G Pay executes a Transaction differently from your Instruction, we will refund the full amount debited upon written communication from the customer.
  • Refunds will be credited back to the same Payment Instrument used for the Transaction and in the same currency.

 

Identity Verification Program

In accordance with Canadian federal and provincial law, 6G Pay must assist in combatting money laundering and terrorism funding. This may necessitate the collection, verification, and recording of identifying information about customers and recipients.

Verification and Checks: 

6G Pay will verify your personal details to confirm your identity and may do the same for recipients. By accepting these Terms and Conditions, you authorize inquiries necessary for validating the provided information, either directly or indirectly through third-party databases.

Confidentiality:

Information obtained during the Service may be confidential. 6G Pay will strive to maintain confidentiality in accordance with the Terms and Conditions, Policies and Procedures, and applicable laws. However, 6G Pay may disclose confidential information if necessary for transaction completion or to comply with the law. The customer acknowledges that 6G Pay is not obligated to notify them before or after disclosing confidential information. The customer agrees not to use 6G Pay’s confidential information for any purpose other than using the Service.

Copyright Information Restrictions on Use:

  • Access to this site is granted for personal use only. Reproduction, modification, resale, or commercial exploitation is prohibited without express written consent. Unauthorized use may violate copyright laws.
  • Content on the Site and Services, including information, software, text, design, images, video, and audio, is owned by 6G Pay and protected by intellectual property laws. Personal use is permitted, but reproduction, distribution, or modification is strictly prohibited.
  • Certain names, graphics, logos, and phrases on the Site constitute trademarks of 6G Pay or its affiliates. Unauthorized use of these trademarks is strictly prohibited.

 

Warranty and Limitations on Liability

Material Breach:

If 6G Pay materially breaches these Terms and Conditions, causing the Sender a loss, the Sender will be refunded the Transaction Amount and Service Fee.

Refund or Compensation:

For delayed, failed, or unauthorized Transactions, the customer may have rights to a refund or compensation. If a Transaction is not properly executed or is delayed, the customer must notify 6G Pay within a reasonable time. Failure to do so may result in the loss of refund or compensation rights.

No Liability for Consequential Damages:

6G Pay is not liable for any indirect, special, incidental, or consequential damages arising from or in connection with the use of the Service, even if 6G Pay has been advised of the possibility of such damages.

Maximum Liability:

In any event, the total liability of 6G Pay for any and all claims related to the Service is limited to the Transaction Amount and Service Fee of the specific Transaction causing the alleged damages.

Force Majeure:

6G Pay is not liable for any failure to perform or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, government actions, natural disasters, or other force majeure events.

Indemnity

You agree to indemnify and hold harmless 6G Pay, its directors, employees, and affiliates, from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Service, any violation of these Terms and Conditions, or any breach of your representations and warranties herein.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of laws principles.

Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms and Conditions, or the breach, termination, or invalidity thereof, shall be resolved by arbitration in accordance with the Arbitration Act, 1991 (Ontario), as amended.

Changes To These Terms

6G Pay reserves the right to amend these Terms and Conditions at any time, and the most recent version will be posted on the website. Users are responsible for regularly reviewing these Terms to stay informed about any changes.

Electronic Communications:

You acknowledge that these Terms and Conditions shall be entered into electronically, and that the following categories of information (“Communications”) may be provided by electronic means:

  • These Terms and Conditions and any amendments, modifications or supplements to it;
  • Your records (e.g. of transactions) through the Service;
  • Any initial, periodic or other disclosures or notices provided in connection with the Service, including without limitation those required by law;
  • Any customer service communications, including without limitation communications with respect to claims of error or unauthorised use of the Service; and
  • Any other communication related to the Service or 6G Pay
  • The Service does not allow for Communications to be provided in paper format or through other non-electronic means. You may withdraw your consent to receive Communications electronically, but if you do, your use of the Service shall be terminated. In order to withdraw your consent, you must contact us using our contact information at the end of these Terms and Conditions.
  • In order to access and retain Communications, you must have or have access to the following:
  • An internet browser that supports256 – bit such as Internet Explorer version 8.0 or above;
  • An e-mail account, e-mail software capable of interfacing with 6G Pay’s e-mail servers and the capability to read e-mail from 6G Pay, and a device and internet connection capable of supporting the foregoing; and
  • Sufficient electronic storage capacity on your electronic device’s hard drive or other data storage unit; or
  • A printer that is capable of printing from your browser and e-mail software.
  • In addition, you must promptly update us with any change in your email address by updating your profile at www.6G Pay.ca

 

Security

6G Pay emphasizes security measures to protect user information. While the Service is safe for trusted transactions, users are advised to exercise caution with unknown entities. 6G Pay takes fraudulent activity seriously and encourages users to report suspicious behavior.
